Terms and Conditions

By accessing or using ZaykaTap, you, as a user, whether a customer, outlet owner, or staff member, expressly acknowledge and agree to be fully bound by these Terms and Conditions. If you do not agree with any part of these Terms, you must immediately discontinue using the Platform. Your continued access and use constitute a legally binding acceptance of these Terms and Conditions.

1. Eligibility and Users:

  • The Platform is accessible to anyone from anywhere.
  • Outlet accounts (owners, managers, staff) must be authorized personnel of the outlet. Only staff added by the outlet owner are allowed to access staff features.
  • Customers can access menus, place orders, and use Platform features without restriction.

2. Account Responsibility:

  • Customers, staff, and outlet owners must provide accurate and truthful information to ensure proper service and reduce misuse.
  • Staff and outlet owners are responsible for securing their login credentials. The Platform does not collect passwords from customers; only basic information (phone number, name) is collected to track orders.
  • Any account misuse should be reported immediately. The Platform will assist in recovery or mitigating damages. The menu data cannot be recovered if deleted.

3. Orders, Payments, and Refunds:

  • Payments are processed directly between customers and outlet owners. The Platform is not responsible for payment disputes.
  • Orders can only be canceled before acceptance by the outlet owner or staff. Once accepted, orders cannot be altered or canceled.
  • Refunds are provided only under the Platform’s subscription refund policy, which should be reviewed before purchase.

4. Content and Behavior:

  • Offensive content, spam, or inappropriate material will result in permanent account termination without prior notice. This includes content against any religion, race, caste, ethnicity, or nation.
  • Users may submit a review request within 7 days if banned. The Platform will review and may reinstate access based on the outcome.
  • Outlet owners must compress images as per platform limits. Menu pricing cannot be zero, and if size/type options are used, pricing must be provided for at least two options plus a base price.
  • Accounts and IP addresses may be banned for platform misuse or abuse.
  • The Platform reserves the right to review, remove, or refuse any content for any reason to maintain platform integrity.

5. Privacy, Data, and Cookies:

  • The Platform collects minimal information from customers (name, phone number) to track orders.
  • For users (staff and outlet owners), IP addresses, device details, and login activity are recorded after each login to ensure account security.
  • Cookies and Tracking:
    • The Platform uses cookies, local storage, and similar tracking technologies to ensure proper functioning of the service, enhance user experience, maintain security, and prevent spam or abuse.
    • Necessity for Service: Without cookies and tracking, the Platform cannot provide key services, including real-time order tracking, menu access, and subscription management.
    • For Customers/Visitors: Minimal information such as IP, device details, and usage patterns is collected to detect fraudulent or abusive behavior. This data is deleted every 15 days unless flagged for abuse.
    • For Users (Outlet Owners and Staff): IP, device details, and login activity are retained as long as the account exists or until termination.
    • Cookies and tracking do not collect sensitive payment information.
    • Users consent to this tracking; disabling cookies may prevent access to essential features.

6. Subscription Terms:

  • Subscriptions can be billed monthly, half-yearly, or annually and may be renewed near or after expiry.
  • Cancellation hides the menu automatically; renewal restores full access.
  • Upon termination, data will be removed after 7 days unless a review request is submitted.
  • Users must provide accurate billing information and successful payment for subscriptions. Refunds follow the Platform’s refund policy.

7. Intellectual Property:

  • Content uploaded by outlet owners remains their property. Users are responsible for copyrighted material they upload.
  • The Platform may use uploaded content for promotion purposes.
  • The Platform may take action against content owned by the Platform without restrictions.

8. Third-Party Services:

  • The Platform may integrate with third-party services, including delivery or payment providers.
  • The Platform is not responsible for the reliability, quality, or disputes arising from these services.
  • Users agree to comply with the terms and conditions of any third-party services used in conjunction with the Platform.

9. Liability and Disclaimer:

  • The Platform is not responsible for food quality, delivery issues, or disputes between customers and outlet owners.
  • Data, including real-time menu or order information, may be lost and cannot always be recovered.
  • Users access and use the Platform at their own risk.
  • The Platform is not liable for indirect, incidental, or consequential damages arising from Platform use.

10. Force Majeure:

  • The Platform is not liable for failures or interruptions caused by events beyond our control, including internet outages, server downtime, natural disasters, or other unforeseen circumstances.

11. Modifications and Termination:

  • The Platform may modify these Terms, features, or policies at any time. Users are responsible for checking updates.
  • Accounts and services may be suspended or terminated at the Platform’s discretion.

12. Governing Law and Compliance:

  • The Platform will cooperate with the government of any nation where services are provided. Content removal requests and other legal obligations will be followed.
  • Disputes shall be resolved under the applicable laws of the relevant jurisdiction. Users agree to comply with lawful orders.

13. Notifications and Communication:

  • Important notices, including subscription renewals, bans, or policy updates, may be communicated via email, phone, or in-app notifications. Users are responsible for reviewing them.
